1. Agreement to Terms

By accessing or using MythicVoices ("the Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

2. Description of Service

MythicVoices is a pay-as-you-go AI voice generation platform designed for tabletop RPG Game Masters and players. The Service allows users to:

• Create and manage campaigns, characters, and game sessions
• Generate realistic AI voices for NPCs and characters using text-to-speech technology
• Store and organize generated audio files
• Generate dialogue and narrative text using AI
• Purchase credits on a pay-as-you-go basis with no subscriptions

The Service is provided "as-is" and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. Account Registration and Eligibility

3.1 Account Creation

To use the Service, you must create an account by authenticating through one of our supported OAuth providers:

• Google OAuth
• Discord OAuth

By creating an account, you agree to provide accurate, current, and complete information.

3.2 Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

3.3 Account Security

You are responsible for maintaining the security of your account and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

4. Credits and Pricing

4.1 Credit System

MythicVoices operates on a credit-based system where:

Credits can be purchased through our secure payment provider, Stripe, in the following packages:

• Starter Package
• Professional Package
• Master Package

All prices are displayed in euros (EUR) and include applicable taxes.

4.3 Credit Usage

Credits are deducted from your account when you:

• Generate audio using ElevenLabs voices
• Generate text or dialogue using OpenAI or Google Gemini

Before generating content, the Platform will display an estimated cost. The actual cost may vary slightly based on the final output.

5. Payment Terms

5.1 Payment Processing

All payments are processed securely through Stripe. We do not store your credit card information. By making a purchase, you agree to Stripe's terms of service and privacy policy.

5.2 Billing Information

You must provide accurate billing information, including:

• Full name
• Billing address
• VAT number (if applicable)
• Fiscal code (for Italian users)

5.3 Invoicing

Italian users may receive electronic invoices through Fatture in Cloud in compliance with Italian tax law. Invoices are issued automatically upon successful payment.

5.4 Taxes

You are responsible for paying any applicable taxes, including VAT, sales tax, or other local taxes. Prices displayed may or may not include taxes depending on your location.

6. User Conduct and Acceptable Use

6.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate real individuals without their consent (including public figures)
• Generate content that infringes intellectual property rights of others
• Generate content for fraud, scams, or deceptive practices
• Generate hate speech, extremist content, or content promoting violence
• Generate sexually explicit content involving minors
• Attempt to reverse engineer, hack, or circumvent the Platform's security
• Use the Service to train competing AI models
• Resell or redistribute generated content as a service without permission
• Automate excessive requests to overload the Platform (abuse/spam)

6.2 AI Service Provider Compliance

You must also comply with the terms of service and acceptable use policies of our AI providers:

• ElevenLabs Terms of Service
• OpenAI Terms of Use
• Google Gemini Terms of Service

6.3 Enforcement

We reserve the right to investigate violations of these Terms and take appropriate action, including:

• Warning or temporary suspension
• Permanent account termination
• Deletion of generated content
• Reporting illegal activity to law enforcement

7. Intellectual Property Rights

7.1 Your Content

You retain ownership of the text prompts you submit and the audio files you generate using the Service.

However, you grant us a limited license to:

• Process your prompts through AI services to generate content
• Store your generated audio files on our servers
• Display your content back to you in the Platform

We do not use your content for marketing or to train AI models without your explicit consent.

7.2 AI Provider Rights

Generated content may be subject to the intellectual property policies of our AI providers (ElevenLabs, OpenAI, Google Gemini). You are responsible for reviewing and complying with their terms regarding commercial use and distribution of AI-generated content.

7.3 Platform Rights

The Platform itself, including its design, code, features, and branding, is owned by MythicVoices and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works of the Platform without our written permission.

8. Content Storage and Deletion

Your generated audio files are stored securely on AWS S3 and remain in your account until you delete them manually.

We are not responsible for:

• Loss of data due to user error (accidental deletion)
• Service interruptions or technical failures
• Third-party service outages (AWS, AI providers)

We recommend maintaining backups of important audio files on your own devices.

9. Disclaimers and Limitations of Liability

9.1 "As-Is" Service

The Service is provided "as-is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation
• Accuracy or reliability of AI-generated content

9.2 AI Content Disclaimer

AI-generated voices and text are created by third-party AI models. We do not guarantee:

• Quality, accuracy, or suitability of generated content
• That generated content will be free from errors or artifacts
• That voice generation will match your expectations

You are responsible for reviewing and approving all AI-generated content before use.

9.3 Limitation of Liability

To the fullest extent permitted by law, MythicVoices shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages arising from your use or inability to use the Service
• Misuse of AI-generated content by you or third parties
• Third-party service failures (AWS, Stripe, AI providers)

Our total liability to you for any claims arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless MythicVoices, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights (including intellectual property or privacy rights)
• Your misuse of AI-generated content

11. Account Termination

11.1 Termination by You

You may delete your account at any time through the Platform settings or by contacting support. Upon deletion:

• Your personal data will be deleted in accordance with our Privacy Policy
• Your generated audio files will be permanently deleted
• Unused credits will be forfeited (no refunds)
• Transaction history will be retained for legal/tax purposes (10 years)

11.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without notice, if:

• You violate these Terms or our Acceptable Use Policy
• You engage in fraudulent or illegal activity
• Your account is inactive for an extended period
• Required by law or legal process

Upon termination for violations, you forfeit all unused credits and access to your content.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through:

• First: Good faith negotiation between the parties
• Second: Mediation (if negotiation fails)
• Third: Binding arbitration or litigation in Italian courts

12.3 EU Consumers

If you are a consumer in the European Union, you also have the right to:

• Bring legal action in your country of residence
• Use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

13. Changes to the Service

We reserve the right to:

• Modify or discontinue any aspect of the Service
• Change credit pricing or package offerings
• Update AI providers or models
• Add or remove features

We will provide reasonable notice of material changes that negatively impact your use of the Service.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MythicVoices regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.
